Adjudicators may face double trouble over proposed tests

Article Abstract:

The Department of Trade and Industry (DTI), in its proposed amendments to the Construction Act, suggested that adjudicators should be both impartial and independent. However, the double tests of independence and impartiality may present a reluctant party with an opportunity to derail the adjudications process and may raise their objections, requiring the adjudicator to give an account of themselves, their financial holdings, and their political holdings.

Article Abstract:

Building contractors, in their enthusiasm to start work or because of a deep-seated aversion to contractual formalities, start on site before the terms of their engagement are agreed, or before signing up to one of various competing forms of contract. It leads to uncertainties and chaos halfway through the job indicating the importance of sorting out the terms of the contract before the work starts.

Planning enforcements demand attention, not deliberate defiance

Article Abstract:

Among the many functions that local authorities carry out, planning control is one function. Planning enforcements demand attention but an act of defiance or even a refusal to comply with an enforcement notice is what led Mr. Goodacre to bring action, who was able to salvage little from his bankruptcy, except for a small strip of landlocked woodland in Sussex.
