Agreement likely on harmonisation of European building industry liability

Article Abstract:

British and European construction industry officials are expected to agree on proposals for the harmonisation of building liability which have been drawn up by the Groupe des Associations Inter-professionnelles Europeannes de la Construction (GAIPEC). The proposals include formal handing over of buildings to clients, a fixed liability period, obliging clients to ensure a warrantee is in place and abolition of joint and several liability. Architects are expected to welcome the recommendations which will place more responsibility on contractors.

Government backs off from quality threshold for competitive tendering

Article Abstract:

Reports that the government is to remove the concept of quality standards from its compulsory competitive tendering (CCT) legislation have thrown the public sector and professional bodies into confusion. The idea of a 'quality threshold' was introduced in 1991 to counteract criticism that CCT would lead to decisions being made on price alone. The Department of the Environment denies any changes are likely but privately admits ministers are reluctant to set quality regulations.

Architects fear 'vortex of litigation' over HSC's health and safety proposals for construction industry

Article Abstract:

The Health and Safety Commission has proposed new regulations on site safety which would hold architects and clients responsible at the design and planning stages of building. Architects fear the new regulations will be unworkable and will lead to litigation. The Association of Consultant Architects is considering challenging the proposals and the European Comminity directive on which they are based in the European courts.
