Article Abstract:

The US government plans to take legal action against the tobacco industry to recover federal funds invested in Medicare and medical payments for government employees. The case will be brought by the Justice Dept under the Medical Care Recovery Act, under which direct recovery of damages can be made against any third party proved to have caused a rise in Medicare costs. There are a number of reasons why the tobacco industry may choose to seek a settlement.

Of cigarettes and silicone: product liability

Article Abstract:

Litigations over silicone breast transplants have had a big negative impact on the industry with Dow Corning even seeking chapter 11 bankruptcy protection. But cigarette makers have lost very little ground in their fight against mass-tort action suits. The reasons for the difference is discussed.

Article Abstract:

Many US states are using the money they received as part of the 1998 settlement with tobacco companies to fund public services such as education and health. Few states are spending the minimum recommended level of the settlement on anti-smoking programmes.
