Issues are presented concerning the allegations of misconduct which have been made against arbitrators for the construction industry. The case of Balfour Beatty v Kelston Sparkes from 2001 is discussed.

Article Abstract:

The case "Balfour Beatty v. Kelston Sparkes," in which Beatty fought against the claim of Kelston, its earthwork subcontractor, for almost UKPd2 mil for further work and delay. A construction arbitrator received the case, but Balfour Beatty throught that the arbitrator was involved in misconduct. However, Balfour Beatty's disagreeing with the arbitrator did not mean that there was misconduct.

Legal matters: Mediation--the implement of choice for disputing parties

Article Abstract:

The role mediation plays in settling disputes is discussed. The factors a court used in coming up with a ruling in the case "Cable & Wireless plc v. IBM UK Ltd" are noted. The ruling on the Alternative Dispute Resolution clause involved in the case is examined.
