Construction litigation is notoriously time-consuming and costly, particularly when that could take any project ending up in court. A case of Skanska versus Egger is described, wherein both the parties failed to adopt a sensible and commercial outlook and ended up in a loss and thus, the importance of three C's, contemporaneous, commercial approach, and co-operation is cited.

However, such agreements are likely to result in disaster with most experienced developers trying to define the formula upon which the divisible element is to be calculated.
