When an expert changes his mind

Article Abstract:

The UK Court of Appeal acknowledged in the case of Stanton v Brian Callaghan that there is an area of uncertainty between an expert's initial advice, upon which prospective litigants rely when deciding whether to instigate legal action, and evidence presented by the expert in court. In the view of the Court of Appeal, there is a point when the involvement of the expert becomes so closely connected with the case that it has an impact on how the hearing will be handled in court. The court emphasized that the main responsibility of the expert is to help the court in solving technical matters and to reach a fair conclusion.

Those with responsibility now stand alone - and liable

Article Abstract:

There are a number of challenges associated with interpreting the Civil Liability (Contribution) Act 1978. This legislation allows defendants to join in other parties to the action if they are liable for the same damage claimed by a plaintiff, and to seek a contribution towards the overall cost. However, it is hard to establish what exactly is meant by 'liable for' and 'the same damage.' It is now increasingly likely that a single defendant will face liability, rather than all the possible defendants sharing liability.

Making the distinction when it comes to compensation

Article Abstract:

There are complex legal issues associated with entitlement to compensation. In some cases, the claimant may not be entitled to compensation which will reinstate the position as it was before the loss arose.
