A long and painful fight

Article Abstract:

A dispute between Alfred McAlpine Construction and Panatown about an office building and multistorey car park constructed by McAlpine for Panatown on the basis of a contract signed in Nov 1989 has involved a great deal of litigation and arbitration. However, the two parties have not yet even reached the point of having a real dispute, as McAlpine exercised its right to try to make a knockout blow. It claimed that Panatown cannot recover compensation because it has never been the legal owner of the site. An arbitrator ruled that Panatown was not debarred from seeking extensive damages.

Article Abstract:

It is quite common in the UK for judges to award damages for distress and inconvenience caused by domestic building works. These cases are usually heard at local county courts, and therefore do not receive much publicity. In a recent case, a judge awarded damages of just over 30,000 pounds sterling against MacBryde Homes after establishing that a family had suffered distress and inconvenience as a result of creaking floorboards in their bedrooms and landing.

Article Abstract:

People buying older properties should use surveyors and pay close attention to the report. If a surveyor fails to note defects and the buyer wins the case, the court attempts to put the buyer in the same financial position if the surveying contract had been properly fulfilled.
