Article Abstract:

The introduction of a legally binding contract governing partnering schemes in the UK construction industry would have to strike a difficult balance between fostering teamwork and ensuring protection for individual firms. The Joint Contracts Tribunal is considering the introduction of such a contract although it would be very hard to draft and operate.

Adjudicating differences

Article Abstract:

The UK government has announced plans to introduce legislation based on the recommendation contained in Sir Michael Latham's 'Constructing the Team' report that a system of adjudication be introduced within all standard forms of contract apart from where 'comparable' arrangements for conciliation or mediation are already in operation. There are still some areas of difficulty to be resolved on this issue. These particularly concern whether there should be restrictions on issues that can be referred to the adjudicator, the liability of the adjudicator and whether the adjudicator should be named in the contract.

The trouble with set-off

Article Abstract:

Many contractual disagreements in the UK construction industry have been caused by the inclusion of set-off provisions in the UK Construction Act. Adjudicators could look at set-off provisions in cases of adjudication, to see if they are within the law and they may use their powers to curtail the level of set-offs. Large construction firms have utilized set-off provisions in contracts in order to retain their funds for as long as possible.
