Proper prudence or restraint of trade?

Article Abstract:

Marinas are limiting the types of work that are provided by mechanics and other independent tradesmen as a way of reducing their exposure to legal threats. Marinas face the growing threats of civil liability, the demands of regulatory compliance and other safety and health issues. However, independent tradesmen claim that the restrictive marina policies, which are claimed to protect the marinas from liabilities, constitute restraint of trade.
