Article Abstract:

A certain procedure must be followed for an injured party to recover costs for head office project staff time lost through breach of contract. The party that sustains a loss because of breach of contract must be placed in the same financial situation as if the contract had been fulfilled. Staff time costs must be untoward and directly linked to the breach of contract. Time lost must be accurately recorded. Not all losses are recoverable. The loss must be one that would be anticipated unless its extraordinariness had been stated prior to the contract formation.

A running jump for judges

Article Abstract:

The 'Access to Justice' report on civil law in England has recently been published by Lord Woolf. Woolf suggests that case management should rest in the hands of the judges. The concept has been in operation at the Official Referees (OR) court for a while now, however, it is argued that giving judges responsibility for managing is in effect giving them two jobs. Arguments against the proposal are included.
