The case of Nolan Davis Ltd vs Steven P. Catton highlights the fact that not all adjudications in the UK construction industry are simple valuation disagreements. In this case, Catton was judged to be personally liable to pay 203,878 pounds sterling to the builder. The judge rejected the argument that there was no jurisdiction to adjudicate because no contract arose.

New UK legislation on rights of audience among solicitors means that solicitors can appear on behalf of their client in court. Many surveyors have become claim consultants and can brief a barrister direct, bypassing the solicitor. However, the traditional way of direct access to specialist construction barristers via a solicitor is still seen as the best method for litigation.

Article Abstract:

It cannot automatically be assumed that those who suffer work-related injuries in the UK construction industry will be judged to be eligible for compensation. Entitlement to compensation depends on a range of factors, and will vary from case to case. In cases where the employer can prove that a safe system of work has been provided, it will be very hard for a claimant to establish entitlement to compensation for a work-related injury.
