Article Abstract:

It is vital to consider impartiality when selecting an adjudicator for a construction contract. Care must be taken to obtain all available information about the adjudicator and his connections with the parties or dispute, then consider whether there is a genuine risk of bias. It is important to remember that a claim of bias can be made even after the adjudicator has reached a decision. It is generally wise to use an Adjudicator Nominating Body.

Bias test for man con professionals

Article Abstract:

Management contractors and construction managers claim to be professionals and this imposes legal obligations on them. Like other professionals, the professional management contractor is responsible to other parties irrespective of there being a direct contract between them. Professionals are assumed to have standards of conduct, impartiality and fairness and are liable for damages if these are not attained.

Article Abstract:

The UK pavillion at the Expo 92 in Seville, Spain was built by Trafalgar House and was given a 25 million pounds sterling grant from the government. No information was readily available on contractual disputes and none on the role of the Chartered Institute of Arbitrators in the construction industry.
