A civilised contract

Article Abstract:

The UK's Institution of Civil Engineers has published a professional services standard form contract for small building works. This could serve as a valuable model for other consultants working on small schemes for how to define professional services relationships with clients. The contract is written in clear, understandable language, and adopts a common-sense approach. It will not ensure that disputes are avoided altogether, but is still extremely valuable.

Article Abstract:

Some courts in the United Kingdom would not insist that construction industry representatives make good their work after being sued for breach of contract. In some cases the client, who has suffered from contractual difficulties, would not be expected to receive compensation or entitlement to rework. The case of Ruxley Electronics and Constructions Ltd v Forsyth is discussed.

Both the ICE (Substructure and alike) and JCT (buildings) short forms of contract are best applied when the supply chain includes smaller providers that dont carry the support of the larger providers. The UK construction industry came under some pressure a few years ago to apply unsustainable business practice. Only experienced value driven buyers are confident applying a non back to back strategy in procurement. From an implimentation prospective it works well because the contract is accessable and understandable.
