Minnesota, MemberWorks agree to settle fraud suit

Article Abstract:

MemberWorks Inc and the office of the attorney general of Minnesota have agreed to settle a consumer fraud lawsuit filed against the telemarketing firm in 1999. Under the terms of the settlement, MemberWorks will pay $75,000 to the state in addition to a number of concessions in the conduct of its business. These concessions include the use of specific wordings in its telemarketing scripts and the use of a minimum font size in its notification letters for membership renewal.

FTC focuses on technology at TSR roundtable

Article Abstract:

Optima Direct pres/CEO Tim Searcy reported that the Federal Trade Commission is not predisposed to make radical changes to the Telemarketing Sales Rule. Searcy represented the American Teleservices Assn during the FTC's roundtable discussion of the telemarketing law. The FTC, according to Searcy, seemed to be more intent in applying the law fairly and wanted the law to continue to be effective with 21st century technology.

MemberWorks settles complaint

Article Abstract:

Stamford, CT-based MemberWorks has entered a settlement agreement with the Office of the Attorney General of New York that is aimed at protecting consumers from unauthorized credit card charges. It has settled allegations of telemarketing abuse in relation to its lifestyle club memberships sales which provide consumers with savings on services and products involving healthcare, shopping, entertainment and home improvement. The deal requires clear, full and upfront disclosures in sales representations.
