Parental responsibility

Article Abstract:

Parent company guarantees can be useful as a form of protection for clients and employers but it should be checked to ensure will fulfill the needs of the clients if contractors fail to meet their obligations. Before using it as part of a contract the status of the parent company should be established to ensure it is not part of another larger company. The guarantee may include a clause which necessitates all measures being taken against the contractor, who is at fault, before the guarantee becomes active. Under the parent company guarantee the parent company acts as a guarantor.

Clause for thought

Article Abstract:

The new engineering and construction short-form contracts is a welcome addition to the series of Engendering Contract documents. Compensation events in the short-form contract are fewer than in the other types of contracts but there may be difficulty dealing with the how compensation is determined. The contracts are are well laid out and follow a logical progression. The guidance notes may help to clarify some details.
