Doing the Continental

Article Abstract:

Construction lawyers in continental Europe are at a loss to understand why their counterparts in the UK are not heavily involved in work relating to public procurement regulations. Indeed, it does seem very difficult to establish why this should be the case. The main reason is probably because the UK's common-law heritage does not prompt people to regard breaches of complex regulations as something that should be the subject of legal action. Procurement regulations do not really fit in at all with the UK's legal system, and have been largely overlooked by construction contractors.

Article Abstract:

Builders and solicitors can work together to help reduce final specified construction costs, although this tends to happen at a local level, where daily or personal contact is permitted. The ability of jobs to come in under specified quotas is based on contracts being more binding than those containing legal regulations.
