Voyage of discovery. (the cost of discovery)

Article Abstract:

Discovery is a costly procedure to those involved in litigation, and discovery in construction disputes is usually onerous due the huge amount of paperwork. Currently each party must disclose any documents with information that could allow a party to advance his case, begin a train of enquiry or damage the case of his adversary.Reducing the burden of discovery has been investigated by a working party, which made proposals to streamline discovery by using procedures similar to those used in international arbitrations.

Having designs on CDM

Article Abstract:

The RIBA has recently published guidance for architects and planning supervisors on how to administer projects carried out under the Construction (Design and Management) Regulations 1994 (CDM). Emphasis is placed on the importance of a unified approach to health and safety in the management of construction, and the guidance also gives details of the obligations and duties under the regulations. It considers the CDM aspects of CE/95 and PS/95.

Changes look like a liability: radical reforms to third-party rights in contract law are unlikely to be better than collateral warranties

Article Abstract:

The Law Commission's report Privity of Contract: Contracts for the Benefit of Third Parties considers major changes to the doctrine of privity of contract. The Commission chose construction contracts to show how reform would be commerciall beneficial. Collateral warranties are common in construction projects and it is uncertain whether any changes would overcome criticisms of such warranties.
