Article Abstract:

Two cases dealing with state law came to different conclusions regarding a seller's liability for environmental damages on property sold on an 'as is' basis. The Seventh Circuit held that Indiana law precluded the seller from liability, but a federal district court hearing a similar case from New Jersey held that New Jersey state law did not prevent such an action. The implications for buyers and sellers, and the effect of federal law on such claims, are discussed.
