Payment procedures

Article Abstract:

The terms set-off, counterclaim and abatement are some of the options in payment disputes. If a contractor requests for more payment than the contracted rate, employer has the right to pay the correct amount and the difference adjusted as abatement. Employer can withhold payment as a claim amounting to a set-off in law, or as a counterclaim that requires a separate claim. The Construction Act specifies that any counterclaim can be referred to adjudication, and decisions given usually within 28 days.
