Scientific publishing in a digital age

Article Abstract:

Scientific publishing in a digital age is discussed with consideration of the problems of the threat to protection of intellectual property. Scientists thrive on exchanging ideas, disseminating research results and ideas, on communication, but the Internet is in some sense still in its infancy, despite all the changes that have come from its use, and the proper protection of material may not be clear to all the users. Fair use and its definition are discussed. Cases discussed include Community for Creative Non-Violence v Reid, American Geophysical Union v Texaco Inc., MAI Systems Corporation v Peak Computer Inc., Advanced Computer Services v MAI, Feist Publications v Rural Telephone Service Co., and that of Triad Systems v Southeastern Express.

Trust is not enough

Article Abstract:

When a valuable employee decides to go to another company, intellectual property may go along and end up at another company. Departing employees or consultants are a major source of information for competitors and of the loss of trade secrets. A court case involving a preliminary injunction to protect the former employer is discussed. Planning ahead to protect trade secrets is important. Three kinds of contractual protections are valuable: noncompete agreements, nondisclosure agreements, and nonsolicit agreements.
