Texas May Appeal Decision Questioning State's 'Preemption' of Air Act

Article Abstract:

The United States District Court for the Western District of Texas ruled in the case of Engine Manufacturers Association et al. v. Robert J. Huston et al. that laws passed by theTexas legislature banning non-road construction equipment use during certain hours or mandating an acccelerated schedule for purchase of certain types of construction equipment conflicted with the Clean Air Act as it imposed emissions standards preempting federal clean air rules.

Administration drops appeal of environmental trade panel decision

The Clinton Administration is to withdraw its appeal of a federal court ruling that requires environmentalists to be included on the government's trade advisory panels. The move is aimed at securing the passage of the China trade package.
