States extend message of Stark referral bill

Article Abstract:

Florida passed a bill to regulate physician-owned joint ventures and referrals of patients to companies such as diagnostic imaging centers, clinical laboratories and radiation therapy service companies in which the referring physician is invested. The Florida bill is similar to a federal bill sponsored by Rep Fortney H. Stark, which went into effect Jan 1, 1992. The Florida bill is one of the most comprehensive of its kind, and other states may use it as a model.

Austin decision good news for peer reviewers

Article Abstract:

A 1992 federal appellate decision has upheld the immunity coverage from antitrust prosecution against physicians who participate in peer reviews. The court ruled that James McNamara and other peer reviewer doctors were not guilty of violating federal antitrust laws when they suspended neurosurgeon George Austin for substandard treatment. The ruling affirms immunity coverage provided in the Health Care Quality Improvement Act of 1986.

States scramble for solutions under new Medicaid law

Article Abstract:

About 30 states will need to change their Medicaid funding systems by Oct 1, 1992, to comply with a new law that almost eliminates provider donations and restricts provider taxes. The law, passed in late 1991, was designed to curb a widely accepted practice of generating federal matching funds by taxing providers, returning the tax payments to them and, then, counting those funds as state spending for Medicaid.
