Closing the ERISA loophole

Article Abstract:

Managed care providers may deny or delay medical services to members of employee health plans because of a provision of the Employee Retirement Income Security Act (ERISA), which protects HMOs from malpractice lawsuits. However, the physician can be sued. The AMA is lobbying to change the law, many of whose provisions have been modified by precedents resulting from interpretation of ERISA in lawsuits.
