What level of scrutiny is required in an antitrust case?

Article Abstract:

The California Dental Association (CDA) has appealed an adverse ruling from the federal Court of Appeals which held that the CDA exerts anticompetitive forces in the California dental market. CDA argues that the codes of ethics and conduct of the association promote competition, and impose no barriers to competition by nonmember dentists. Further, CDA argues that a full review of the impact of the CDA on the market in dentistry must be undertaken before an antitrust decision can be rendered.

Antitrust revisited: the pitfalls of the Messenger Model

Article Abstract:

The effectiveness of the Messenger Model, a negotiation method between healthcare practitioners and insurance organizations, is assessed. The case details concerning Federal Trade Commission (FTC) complaint on North Texas Specialty Physicians (NTSP), where the model was used with large network of healthcare professionals, is presented. FTC complained that NTSP had bargained for higher fees from insurance plans and thus violated the antitrust laws.
