Commissioner v. Schleier, ____ U.S. ____ (1995), 19 EBC 1377

Article Abstract:

The Supreme Court has ruled that employees' recovery of back pay and liquidated damages in a settlement award under the Age Discrimination in Employment Act of 1967 is not excludable from their gross income. The amount of damages received on account of personal injuries or sickness are excludable from gross income under Section 104(a)(2) of the Internal Revenue Code.

Employer interference with ERISA rights and benefits

Article Abstract:

The law governing employer interference with ERISA benefits and rights is discussed. In the case of DiFederico v. Rolm, the court ruled that the former employee must prove the employer had a specific intent to violate Section 510 of ERISA, and so avoid long-term disability costs.

Participant status - standing to sue for benefits under ERISA; temporary and leased employees; antiretaliation protection

Article Abstract:

The law on whether someone qualifies to bring an action for benefits under an ERISA plan is discussed, in the light of Wolf v. Coca-Cola. Individuals must prove they are or were employees and were entitled to ERISA benefits.
