ENDA promises to ban employment discrimination for gays

Article Abstract:

Homosexuals suffering from employment discrimination have no legal recourse under existing laws. Because there is no law as yet that expressly forbids employment discrimination based on sexual orientation, employers can fire, demote or refuse employment to gays and lesbians on the ground of their sexuality alone. This may soon change if Congress passes the Employment Non-Discrimination Act (ENDA). This bill seeks to protect gays, lesbians and bisexuals from discrimination in employment and in the workplace. It contains provisions that make it illegal for employers to use an individual's sexual orientation in making employment decisions, and those that provide effective legal remedies for violations of the law. ENDA does not apply to religious organizations and to the military. The issue of gays in the Armed Forces, however, is being considered in other bills under review in Congress.

Article Abstract:

Many gay employees have begun to establish associations and support groups to educate other employees about homosexual workers and reform the employee benefits system. Gay employees who feel they must hide their homosexuality are often forced to develop elaborate defenses, such as laughing at jokes about homosexuals and pretending they have been married. This behavior detracts from gay workers' psychological well being in the workplace. Homophobia prevents employees from working with a large portion of the work force, and employers should realize that recognizing the value of gay employees is part of accepting the diversity of the work force. The issues that concern gay employees in the area of equal employee benefits include non-discrimination policies, bereavement leave for domestic partners, and health care benefits for domestic partners.
