Three strategies help attack liability perils

Article Abstract:

Insurers should take a realistic look at their potential liabilities and recognize the fact that some employee somewhere is likely involved in an activity that would be considered an actionable cause under insurance law. Once this is recognized, insurers can get over the constant hand-wringing of always trying to comply with the law and move on towards an effective strategy of damage control. This involves encouraging people not to sue, taking actions that limit their ability to sue, and fighting for the lowest remedies possible.

Article Abstract:

Insurance companies need to establish a compliance program to prevent and discourage violations of the law. Federal indictment of insurance companies and their executives has been rare but the passage of the Federal Insurance Crimes Act will cause a rise in insurance company prosecutions. Compliance programs will help minimize the fines imposed. These will also act as deterrents to the commission of crime in the first place.

The struggle over underwriting guidelines

Article Abstract:

Insurance companies claim that discrimination is not happening any longer because they are establishing their own guidelines known throughout the industry but not by consumers or regulators. An investigation found that discrimination does still exist because of geographic location, age of home, marital status of occupants and past rejections for insurance coverage.
