BIDs fare well: the democratic accountability of business improvement districts

Article Abstract:

Municipal business improvement districts (BIDs) have often been criticized as giving too much control to private interests and not being accountable to the public. However, because BIDs are generally small with specific mandates, accountability is not as big a problem as it would be in larger units. Also, BIDs are organized so that they actually are quite accountable to both stakeholders and residents of the areas they cover.

National League of Cities rising: how the Telecommunications Act of 1996 could expand Tenth Amendment jurisprudence

Article Abstract:

Section 332(c) of the Telecommunications Act of 1996 requires states to regulate the telecommunications industry according to national standards. The idea expressed in National League of Cities v. Usery that courts must preserve some area of state sovereignty should be examined in light of this issue. Section 332(c) then would be seen as violating the 10th Amendment.

The Federal Energy Regulatory Commission and environmental justice: do the National Environmental Policy Act and the Clean Air Act offer a better way?

Article Abstract:

The Federal Energy Regulatory Commission has consistently refused to take the poor and minorities into account when making regulatory decisions. Remedies for FERCs denia l of environmental justice can be found in the Clean Air Act and the National Environmental Policy Act of 1969.
