Case C-293/02, Jersey Produce Marketing Organisation Ltd v. States of Jersey and Jersey Potato Export Marketing Board, Judgment of the Court (Grand Chamber) of 8 November 2005

Article Abstract:

The European Court of Justice's intriguing judgment on the Jersey Produce Marketing Organisation Ltd v. States of Jersey and Jersey Potato Export Marketing Board is discussed. An attempt is made to analyze the most important issues arising from the judgment, and an explanation as to how the Court appears to be transforming the traditional test used to determine whether a situation falls within the scope of the Treaty provisions on the free movement of goods is presented.

''The winner takes it all'': Recovering lawyers' fees and other costs before the Community courts

Article Abstract:

The Community courts determine the award of costs in accordance with certain set rules according to which the judgment on the main action determines only who should bear the costs and not the amount of the costs to be recovered. The rules on the award of costs and their application in practice by the Community institutions and the Community courts are examined.
