Article Abstract:

Parties adversely affected by the actions of trade unions in the United Kingdom are finding more recourse to the law. Employers, customers, suppliers and union members all have the ability to take legal actions against unions. The most common action sought is an interlocutory injunction to bar the industrial action from occurring. Damages are also sought by some parties who claim an economic loss. The evidence most often used in such cases and the effects these cases have had on industrial relations are discussed.

Busy year for Certification Officer

Article Abstract:

The Certification Officer's (CO) annual report for 1994 reviews the 11 formal decisions he made and notes his informal investigations into several groups' financial affairs. It also observes a decline in listed trade unions from 287 in 1993 to 267 in 1994, and a 3% decline in membership, to 8.7 million, from 1992 to 1993. The CO received three applications for certificates of independence in 1994, and issued three certificates, two of them for 1993 applications. Other activities and investigations are described.

Article Abstract:

The United Kingdom's 1981 Transfer of Undertakings Regulations are being interpreted by tribunals and courts using an employment perspective. Even if a business does not transfer goodwill or assets, a transfer may exist as an economic entity that affects the employees. Thus, if work continues or resumes as before, an economic entity has retained its identity in a transfer. There is no common factor in all transfer cases, but the new perspective facilitates compliance with the European Community.
