Competition policy

Article Abstract:

The European Commission (EC) aims to cooperate with national competition authorities in deciding cases, with the EC focusing on cases which are of special interest to the European Community. The EC has approved several mergers, including the merger of UK companies Grand Metropolitan and Guinness, the purchase of UK-based ICI's titanium dioxide business by DuPont of the US and the merger between Tandem Computers of the US and Compaq Computer Corp. Microsoft's activities in the EU market will be investigated, while Digital Equipment Corp has made undertakings on the pricing and supply of its hardware and software.

Article Abstract:

The Commission has provided guidelines on fines for breaching competition rules in the EC and ECSC treaties. The three levels of gravity are minor, serious and very serious infringements, also taking into account the duration of the infringement. Merger control included the clearing of the planned acquisition by Siemens of control of Elektrowatt, and Veba's planned acquisition of Degussa. It has also started further investigations into the mergers of four the the top six international accountancy firms.

Article Abstract:

A positive comity agreement has been signed between the EU and the US which builds on an earlier 1991 agreement on competition matters. With regard to merger control, the Commission's merger task force has cleared acquisitions, including those by Cendant of National Park Corp, the acquisition by Koch Industries of Eurosplitter and the joint acquisition by GKN and Brambles of SKP. Other issues include conditional approval for airline alliances, and settlement of the case against Nordion.
