Counsel in Marvel case knocked out; Del. court adopts strict rule on debtor-creditor conflicts

Article Abstract:

Criticism of a federal judge's 1998 ruling that former federal judge and Marvel Corp. trustee could not hire his own firm as counsel in Marvel's bankruptcy suit because it was not a disinterested party has already begun. Bankruptcy experts fear the opinion sets up a per se rule on conflicts for elaware's bankruptcy courts. The US trustee for the 3d Circuit has instructed counsel to use the heightened-conflict standard in any new cases of past representation of creditors by debtors' counsel.

Lawyer indicted in sting

Article Abstract:

Baltimore, MD, attorney, Nelson R. Kandel, has been indicted on charges of insurance fraud, felony theft and soliciting the filing of fraudulent claims, as the result of a state police sting operation. Perhaps as many as 10 doctors and lawyers may eventually face charges stemming from the investigation. The insurance industry cooperated in the automobile injury fraud investigation.

The next step: the mini-trials

Article Abstract:

Individual trials for over 8,500 remaining claimants in the asbestos litigation will start in Nov 1992. In the consolidated trial, which ended Aug 10, 1992, GAF Corp, Keene Corp, Pittsburgh Corning Corp and the Porter Hayden Co were ordered to pay punitive damages of up to 2 1/2 times more than they did to workers in compensatory damages.
