Definitions and continuity

Article Abstract:

The availability of employment protections for participants in fixed-term contracts, such as apprenticeship contracts, is often negated due to difficulties in establishing continuity of employment. Courts examine the regularity of work-cessation periods in determining continuity. These contracts are defined as being for a specified stated term, and are distinguishable from similar contracts automatically ceasing upon certain specific events.
