Ethics crossfire: two legal titans face off

Article Abstract:

One way of defending the ethics of attorneys with full-time positions working for those in accounting and investment banking who offer legal services is to say they are basicaly the same as corporate in-house counsel, but the financial incentives, ethical pressures and potential damage to clients are actually far greater with the former. Global competition and technological innovation in information creation and transmission, and these two information functions are the essence of law practice. Law practice must change with the times.

Conservative fee plans penalize poor clients

Article Abstract:

A plan promoted by the Manhattan Institute to repair alleged problems in the current rules on contingent fee compensation for lawyers is actually an attack on plaintiffs and their lawyers. After failing as an amendment to the US House's Common Sense Legal Reform Act, it has appeared in several state legislators and won support from surprisingly liberal figures, so it must be taken seriously. The plan would make contingency fee clients seek an early offer from the defendant and make unusually early disclosures.

Article Abstract:

A lawyer spoofs the end of an attorney-client relationship with a letter ending such a relationship from the attorney's perspective. Written like a note ending a relationship between a boyfriend and girlfriend, the attorney comments on problems which undermine attorney-client relationships, such as lack of communication, competition, and billing and auditing disputes.
