Fake evidence becomes real problem: from fingerprints to photos to computer data, lawyers are learning to be vigilant

Article Abstract:

A rash of recent evidence-falsification cases suggests lawyers must be more vigilant and skeptical concerning experts and physical evidence that seems too good to be true. However, some observers say advancing technology is simply revealing more of what has always gone on undetected. Examples include fingerprints falsified by NY state troopers, fake autopsy reports in TX, false search warrants in Philadelphia, a photo faked by a San Francisco security guard and evidence falsification by a blood expert in WV and TX.

DA: condom protected rapist; grand jury won't indict

Article Abstract:

A grand jury in Austin, TX, has refused to indict an alleged rapist who agreed to his victim's request to wear a condom. The lawyer for the suspect successfully argued that the condom offer constituted consent. The condom also prevented physical evidence, semen, of the assault. Victims' rights groups were dismayed by the case and protested the grand jury's decision.

Three grand juries hear case; critics charge race bias

Article Abstract:

A murder case complicated by racial factors is now before a third grand jury in Texas. The case involves the murder of a black man by a Vietnamese clerk in a store. Membership of the third grand jury includes two Asians and two Afro-Americans. Representatives of the Asian community claim this is a self-defense case which has been politicized.
