Family law; religion as a custody issue

Article Abstract:

Issues regarding the consideration of religious factors in custody and visitation disputes are discussed. Courts have interpreted the First Amendment's establishment and free exercise clauses as limiting their ability to consider religion in custody and visitation disputes. Exceptions to this rule are discussed.

Family law; custody relocation cases

Article Abstract:

Tips for family law attorneys faced with custody relocation cases are given. The court will emphasize potential improvement in the child's quality of life as a result of the move, the parent's motivation for moving and the effect of the move on the child's relationship with the non custodial parent.

Stepparent custody and access

Article Abstract:

Stepparents can face many legal issues if they want child custody or visitation when they divorce or the child's biological parents die. Establishing standing to petition the court for child custody or visitation is the first obstacle, and the second is whether the stepparent can overcome the parental preference, and finally whether the stepparent can show that custody or visitation with him would be in the child's best interest. Strategies for addressing these issues in litigation are detailed.
