Freedom to provide services - prohibition of dissemination of information about hospitals in other member states that perform abortions

Article Abstract:

The European Court of Justice (ECJ) was asked to rule on several questions regarding the legality under European Community (EC) law of actions and policies opposing abortion by the Society for the Protection of Unborn Children in Ireland. The Court rejected the Society's argument that abortions are so wrongful that they cannot be deemed a service under Article 60 of the Treaty Establishing the European Economic Community. It ruled that under EC law a member state in which abortion is illegal may keep student groups from providing information about abortion services elsewhere.

Treaty on European Union is contrary to French Constitution - amendments to Constitution - national sovereignty

Article Abstract:

The French constitutional court has ruled that the Treaty on European Union contains unconstitutional provisions and will require a constitutional amendment before ratification. The unconstitutional provision was the possible infringement of national sovereignty. The Maastricht Treaty's provisions relating to the establishment of a single exchange rate system, a common visa system, and the recognition of European Community (EC) nationals' rights to municipal political participation in their EC residence were held to be the possible infringements of national sovereignty.

European Convention on Human Rights - respect for private life - prohibition on homosexuals in the British armed forces

Article Abstract:

The European Court of Human Rights ruled in two cases against the UK policy of excluding homosexuals from military service merely on the basis of their sexual orientation as a violation of human rights.
