Georgia AG is rebuked in employment case

Article Abstract:

Georgia Attorney General Michael J. Bowers has been criticized in a US District Court opinion which declines a motion to dismiss a suit against his office. The suit was brought by a lesbian attorney who had a job offer from Bowers' office withdrawn after her plan to marry her lesbian lover came to light. Judge Richard C. Freeman's Mar 6, 1992 decision criticizes both defendant and plaintiff, but calls Bowers' actions worse, claiming his arguments misconstrue the Supreme Court ruling in Bowers v. Hardwick, which upheld Georgia's sodomy law. Judge Freeman warned both parties that continued improper argumentation will lead to Rule 11 sanctions.

Fired for being gay, he's sued over clients; an accountant's former boss sues him - and wins - for taking business with him

Article Abstract:

Daniel C. Miller must pay $150,000 for violating the noncompete clause of a contract after he was fired for violating another clause, by being homosexual. The Pennsylvania and US supreme courts refused to hear his appeal after a state appeals panel, by a 2-1 vote, decided that enforcing the noncompete clause did not amount to state action in supporting discrimination. After being fired Miller opened a competing practice and took several clients, making him liable to pay his former boss 125% of the previous year's charges for each.

Dalila Kamal-Griffin, a French woman with law degrees from the Sorbonne and American law schools, is accusing New York's Cahill, Gordon and Reindel and Curtis, Mallet-Prevost, Colt and Mosle of discrimination against foreigners in violation of the Immigration Reform and Control Act of 1986 in rejecting her job application. Her federal civil lawsuits are on hold pending the outcome of administrative proceedings. She believes there are many in her situation and may turn the civil suits into class actions.
