Legal spin control: ethics and advocacy in the court of public opinion

Article Abstract:

Attorneys are increasingly being called upon to be their clients' advocates in the court of public opinion as well as law and public opinion can strongly influence cases. However, no legal ethics standards has been developed to provide guidance for this phenomena. Since attorneys are acting in their clients' interests, some regulation would be valuable to prevent a public backlash that could restrict attorneys abilities to provide their clients with necessary advocacy.

Making moral theory work for law

Article Abstract:

Contemporary legal reasoning and decision making is beset with problems that can be alleviated, contrary to the views of Richard Posner and others, by using the methods of moral theorists. Moral theory aids in clarifying issues and formulating questions. Through these means, moral theory can help to realize the potential of oral argument to conduct balanced inquiries and to provide for full judicial consideration of disputed points in contested areas.
