No-standing zone deters citizen suits; a spate of recent decisions, including the Supreme Court's 'Steel Co.' ruling, could raise barriers to private plaintiffs' actions

Article Abstract:

The law of standing continues to be a complex issue in environmental cases, with measuring the plaintiff's claimed injury-in-fact and the redressibility requirement the most contentious issues. The Supreme Court dealt with redressibility in Steel Co. v. Citizens for a Better Environment. The court found that the group failed to meet the redressibility requirement, lacing standing with its claim of whooly past violations of two environmental laws. Steel Co. and later decisions could impact the filing of citizen suits and how they are prosecuted.

Technology export rules are elusive; complex regulations determine whether the overseas shipment of software requires licensing

Article Abstract:

The US Department of Commerce's Bureau of Export Administration regulates the export and re-export of technology and software very strictly, and many of these provisions are complex and difficult to understand. The Bureau generally regulates the re-export of controlled U.S.-origin technology or software incorporated in foreign-origin products.
