Playing hardball at Microsoft; chief counsel William Neukom is leading a legal chage that verges on either risky or brilliant - or both

Article Abstract:

William H. Neukom, the senior vice pres for law and corporate affairs at the Microsoft Corp, is handling the corporation's defense in the government's antitrust lawsuit. According to legend, Bill Gates's father chose Neukom, then a young lawyer at his Seattle firm, to work out an office lease for Gates and his colleagues in 1979 when they moved to Seattle from Albuquerque. Microsoft went public in 1980 and both the rapid growth and the lawsuits started. Many believe Neukom's confrontational legal style is designed to provoke the judge into appealable error.

Article Abstract:

Loren A Smith became chief judge of the US Court of Federal Claims in 1985 and the court has been a vehicle for him to assert leadership in a mainly libertarian movement in takings law, trying to make Fifth Amendment property rights equal to First Amendment speech rights. It is the only independent Article I Court under the Administrative Office of US Courts (AOC). The AOC is more inclined to make appropriations for the Article III judiciary.
