Sex wars redux: agency and coercion in feminist legal theory

Article Abstract:

Dominance feminism, which focuses on subjugation of women through male-dominated sexuality, and agency theory, which focuses on sexual empowerment, should be seen as components of feminist thought that can coexist. Legal issues such as the censorship of pornography have polarized feminists depending on whether they choose to oppose male sexual oppression or choose to defend the complexity of women's sexuality. A theory of partial agency should be integrated into existing feminist jurisprudence to promote critical thought on jurisprudence that perpetuates women as objects.

Theorizing yes: an essay on feminism, law, and desire

Article Abstract:

The author examines feminist legal theories and their lack of a positive theory of female sexuality, which precludes the possibility of non-reproductive female sexual desire, that a woman could say "yes", and advances that the only acceptable view of sexual proposition is negative, that a woman will say "no".
