Step by step: how the U.S. government adopted the ADR idea

Article Abstract:

The US government has officially supported ADR since 1990 and has continued to expand its support. The Administrative Dispute Resolution Act was passed in 1990. It was permanently extended in 1996. Executive orders, policy statements, and directives involving federal acquisition contracts and military procedures have also established ADR guidelines. The US government can benefit from ADR because it is subject to more litigation than any one corporation.

California lawmakers turn focus toward ADR

Article Abstract:

California legislative action during 1994-1997 testifies to the growing importance of arbitration. The Legislature expanded the areas in which arbitration can be used. It also submitted a bill which would have made mediation mandatory in many civil cases, but it was not passed. State Sen Bill Lockyer submitted a bill which would void legally erroneous arbitration decisions.

The role of the ADR in managed care disputes

Article Abstract:

The use of alternative dispute resolution to settle claims and provider disputes involving managed health care is discussed. Topics include the status of managed care dispute remedies, proposed legislation to set federal standards for resolving managed care disputes, and model ADR techniques as a means of health care dispute resolution.
