The Brady rule: is it working? Its 30th anniversary is marked by debate

Article Abstract:

Criminal defense attorneys charge that prosecutors routinely violate the Brady rule, which requires the prosecution to show the defense all exculpatory evidence. Prosecutors counter that a finding that evidence is Brady material is a judgment call, claiming that violations are rarely intentional. Some states attempt to ensure obedience to the Brady rule with open-file systems. The rule is part of the ABA Model Rules of Professional Conduct and the ABA Criminal Justice Section Task Force on Discovery Standards will issue a report on ways to open up discovery.

Zealous pro bono work leads to libel lawsuit

Article Abstract:

The Washington law firm of Arnold and Porter did a high-profile pro bono representation of Roger Keith Coleman trying to forestall his execution and introduce proof that a neighbor, Bobby Donnie Ramey, was guilty of the murder in question, not Coleman. Their efforts on behalf of Coleman were unsuccessful and Ramey has sued the firm for libel. Arnold and Porter had made extensive use of the media during their representation of Coleman and if Ramey's suit is successful, attorneys for those on death row may be reluctant to use the press.
