United they sit; last term suggests 5-4 splits likely in areas of federalism, civil rights, religion

Article Abstract:

The 5-4 split between the conservative and liberal justices of the US Supreme Court in the 2000-2001 term is discussed, with one-third of the term's cases ending in 5-4 rulings. In the last several terms federalism, civil rights and religion rulings have all been conservative.

States rights gamble: tribal casino gambling triggers federalism issues for Supreme Court

Article Abstract:

On Oct 4 the US Supreme Court will hear arguments in Seminole Tribe v Florida, which raises questions about federalism in the context of regulating gaming on Native American reservations. FL argues that the Indian Gaming Regulatory Act of 1988 illegally waives states' sovereign immunity and treats them as a branch of the federal government, ordering them to negotiate with tribes. An 11th Circuit ruling supports the state. The Clinton administration sides with the tribes. The Supreme Court has long been divided on this federalism issue.

States on a winning streak: 11th Amendment ruling strikes another blow against federal power

Article Abstract:

The US Supreme Court's ruling in Seminole Tribe of Florida v Florida extends a trend in the court favoring states' rights over congressional authority. The ruling struck down Congress's power to subject a state to lawsuits in federal court, and follows other decisions regarding a ban on handguns near schools and a law forcing states to accept nuclear waste dumps. The rulings, each by a 5-4 majority, have led lower courts to strike down a variety of federal laws. Further Supreme Court decisions will hinge on Justice Kennedy.
