Viatical settlements: new opportunities for wealthy individuals and business owners

Article Abstract:

The favorable tax treatment of life insurance on terminally or chronically ill persons provides new tax and estate planning opportunities for third-parties purchasing such policies through viatical settlement companies. The Health Insurance Portability and Accountability Act of 1996 provides for gross income exclusion of the proceeds for those holding specified viatical settlement policies. Look-alike policies which do not meet the statutory criteria for favorable tax treatment could still be of planning use for some.
