Violent gang behavior is no civil liberty

Article Abstract:

Injunctions against gangs as a public nuisance have proven highly effective in California, but the California Court of Appeal recently upheld a case brought by the American Civil Liberties Union saying courts cannot prohibit activity not expressly illegal. Many jurisdictions are worried that the California Supreme Court, which has agreed to review the decision, will overturn a proven technique for controlling gangs without filling prisons. Many legal activities can become unreasonable and a public nuisance, making them subject to injunction.

The exclusionary rule was appropriately used

Article Abstract:

Federal district Judge Harold Baer applied the exclusionary rule correctly in United States v. Bayless, suppressing drug evidence seized from a car in an alleged center of drug activity. Believing that Bayless acted like a drug courier was not probable cause to stop the car and conduct a search. The anger of 'tough on crime' advocates at the decision was misplaced. Such advocates should refrain from harassing independent judges trying to protect constitutional rights.

'Jheri Kurls' trademark of uptown gang

Article Abstract:

A group of Dominicans known as the 'Jheri Kurl Gang' is on trial for murder and drug trafficking in New York. Federal Drug agents allege that Dominican cocaine gangs have turned the Washington Heights are of Manhattan into 'Miami on the Hudson.' The Jheri Kurls, named after the somewhat out-of-fashion hairstyle they prefer, are accused of running a multi-million dollar cocaine operation in Manhattan and of laundering their profits in the Dominican Republic.
