Who and what is transferred

Article Abstract:

Employee contracts for particular undertakings can be automatically transferred under UK law. Transferability depends on whether an employee is actually employed, rather than assigned to, a particular undertaking. In order to be considered transferred, an employee must be employed immediately prior to the transfer. Transfer-related dismissals are automatically considered unfair and employees can object to transfers. Employees' current terms of employment, as well as any rights and liabilities, are automatically transferred under UK law.
