The doors are locked but the thieves and vandals are still getting in: a proposal in tort to alleviate corporate America's cyber-crime problem

Article Abstract:

A new tort making corporations without adequate security to prevent hacker intrusions guilty of negligence would stanch the growing problem of US corporate computer crimes. Existing legal remedies in criminal law, contract law, and the Uniform Commercial Code do not suffice for the task but a new tort in negligence would. Using tort law against hackers deters them from infiltrating businesses because of the threat of financial penalties. It also encourages socially responsible behavior by corporations, a computer network security system showing reasonable care.

Book versus byte: the prospects and desirability of a paperless society

Article Abstract:

An analysis of the relative strengths and weakness of paper versus electronic recordkeeping methods is presented. The article contrasts the fragility of digital electronic media with the long-lasting qualities of paper and argues that paper should remain as a valuable tool in the face of digitalization.
