Judge thwarts efforts to copy Clinton videotape

Article Abstract:

A coalition of media organizations, including television networks and media rights groups, was denied access to copies of Pres. Clinton's testimony in the Whitewater trial that lead to the conviction of James McDougal, Susan McDougal and Jim Guy Tucker. The government has argued that the tape should not be disclosed because of potential election year misuse. The court found that viewing of the tape in court satisfied public access needs. The US Court of Appeals for the Eighth Circuit has accepted review of the sealing of the court record by the trial court.

Federal judge can't order state court open

Article Abstract:

The US Court of Appeals for the 11th Circuit in Simmons v. Conger ruled that the plaintiff failed to state a federal claim because she alleged a constitutional violation by a state court judge that operating within the bounds of statute in closing his court. The plaintiff was a member of a group opposed to the state judge. A state court proceeding was closed by request of the parties involved. The 11th Circuit found that federal courts did not have the power to overturn a closure order that was within the state court's discretion.
